IMPARTIAL FACILITATION

A structured opportunity to reach agreement.

A mediator helps parties explore a resolution. The parties decide whether to settle and on what terms.

HOW MEDIATION WORKS

From disagreement to a documented outcome.

1. Initial review

We ask for a brief outline and the names of the parties. We check suitability, conflicts and availability before confirming an appointment. Please do not send sensitive evidence through the initial form.

2. Preparation and terms

The parties agree the process, participation arrangements, fee basis and confidentiality terms. Preparation helps identify the issues, relevant documents and people with authority to settle.

3. Facilitated discussion

Sessions may involve joint discussion and separate meetings. The process explores interests and options without requiring a party to accept a settlement.

4. Recording an agreement

For matters within its scope, section 82 of Nigeria’s Arbitration and Mediation Act 2023 provides for enforcement of mediated settlement agreements. The requirements, applicable exceptions and appropriate route must be considered for the particular agreement; enforcement is not automatic in every dispute.

PRACTICAL QUESTIONS

Timing, cost and confidentiality.

How long does it take?

A timetable depends on party readiness, document preparation, the number of participants and the complexity of the issues. Ask for an indicative schedule after the initial review; we do not promise a fixed settlement deadline.

How are fees agreed?

Request a written proposal describing preparation, session fees, follow-up and any venue or travel costs. The fee basis and payment responsibilities are agreed before work begins.

How does it compare with litigation?

Mediation can give parties more control over scheduling and the terms of a resolution. Whether it reduces time or cost depends on the case, the parties’ participation and whether agreement is reached.

Is the process confidential?

Confidentiality is addressed in the mediation terms and applicable law, with relevant exceptions. Ask about information handling, private meetings and disclosures before sharing sensitive material.

Are all matters suitable?

No. Urgent protection, safeguarding concerns, power imbalances or legal restrictions may require a different route. Family matters receive particular attention to suitability and safety.
